These terms explain how we act for you as an auctioneer when selling your items and how sale proceeds, fees, and responsibilities are handled.
In summary: you appoint Quire Auctions Ltd as your agent, confirm that you own the items and that all information you provide is accurate, and agree to our commission and charges.
Estimates are for guidance only, payment is made after buyer funds clear, and you may be responsible if a buyer successfully challenges the authenticity of a lot.
The handling of client money is governed by our Handling Client Money Policy, which forms part of and should be read together with these Terms & Conditions.
Please read the full terms below before consigning items for sale.
We act as your agent when offering items (“Lots”) for sale. Ownership passes to the Buyer only once full payment has been received.
By consigning items to us, you confirm that you own them or are authorised to sell them.
You must provide valid identification, proof of ownership, and accurate information about the Lots.
We may refuse any Lot at our discretion.
Estimates are for guidance only and are not guaranteed selling prices.
We may group, split, or catalogue Lots as we consider appropriate.
Our standard commission is 12% of the Hammer Price, inclusive of loss and damage cover, with a minimum charge of £10 per Lot.
Photography fees, VAT, and other agreed third-party costs may apply.
We accept limited custodial responsibility while Lots are in our possession, subject to stated exclusions.
Our liability is capped at the lower of the low estimate or the Hammer Price.
Lots may be sold with or without reserve, as agreed.
We may bid on your behalf up to the reserve but you must not bid on your own Lots.
You confirm that Lots are free from third-party claims and comply with all applicable laws.
You agree to indemnify us against claims arising from inaccurate or misleading information.
We control the conduct of the auction, including bidding increments, lot order, and withdrawal.
Unsold Lots must be collected promptly or may incur storage charges.
Withdrawn Lots may be subject to commission and administrative fees.
We will pay you within 15 working days of receiving cleared funds from the Buyer.
We may deduct any sums owed to us before settlement.
Seller proceeds are held as client money in accordance with our Handling Client Money Policy until settlement has been completed.
If a Buyer’s authenticity claim is upheld, you may be required to refund the sale proceeds.
Our liability is limited as set out above. These Terms are governed by the law of England and Wales.
Illustrations are produced to sell and to showcase lots, and any other book or item included in photographs are not included in the lot as described. Descriptions, which include quantity and describe the entire lot as is, are final, and any attempt to suggest that inclusion in a photograph is implicit will not be entertained.
